A Fundamental Shift in Federal Policy

The now-rescinded policy, established under the Biden administration through memorandums M-22-18 and M-23-16, represented a significant effort to secure the federal software supply chain in the wake of high-profile cyberattacks. This framework compelled federal agencies to obtain two key deliverables from their commercial software providers. In contrast, the new directive, M-26-05, nullifies these mandatory requirements, reframing them as optional tools rather than essential prerequisites for federal procurement. The official rationale provided by OMB Director Russell Vought casts the previous mandates as “unproven and burdensome software accounting processes that prioritized compliance over genuine security investments.” The argument is that the one-size-fits-all approach stifled agencies’ ability to create security assurance programs tailored to their specific operational needs and risk profiles. While agencies can still request SBOMs and attestation letters, the decision to do so is now entirely discretionary. The responsibility has been shifted, placing the onus on individual agencies to develop their own assurance requirements based on their unique threat landscapes, while still maintaining the overarching duty to inventory their software and hardware assets.

The Argument for a Stronger Federal Mandate

The primary concern is that federal procurement officers, stripped of a clear directive and the tools to enforce higher standards, will be unable to adequately verify the security posture of the software they acquire. Proponents of the new policy, such as Tim Amerson, Federal Field CISO at GuidePoint Security, argue that the effort under M-22-18 was often “optimized for documentation over risk reduction.” He observed that many agency teams expended significant resources collecting security artifacts like SBOMs but frequently “lacked the maturity, tooling, or threat context to operationalize them.” In this view, the process had devolved into a compliance-focused, box-checking exercise rather than a meaningful strategy for mitigating tangible threats. The collection of documents became the goal itself, overshadowing the more critical objective of actually improving security outcomes and reducing the federal government’s attack surface.

This perspective champions the newfound flexibility granted by M-26-05, praising its shift in focus toward holding agencies accountable for security outcomes rather than paperwork. Experts who support the rollback believe it more closely aligns with modern security paradigms, such as zero-trust principles and sophisticated risk management frameworks. They contend that the new approach explicitly ties security decisions to mission-specific risk, the dynamic threat environment, and potential operational impact, moving away from a rigid, universal checklist. Despite the starkly opposing views on the rollback’s merits, a consensus has emerged around a profound concern: the risk of inconsistency and fragmentation across the federal government. With the removal of a universal baseline, the responsibility for defining and enforcing software security standards now rests with individual agencies, whose cybersecurity maturity levels and resources vary widely. This decentralization has prompted warnings from experts like Kevin Kirkwood, CISO at Exabeam, who fears that the OMB is “betting heavily on agency discipline and procurement rigor” without providing a new mandatory minimum. The apprehension is that less mature or under-resourced agencies will “quietly relax requirements,” creating a fractured marketplace where vendors can direct their “weakest practices to the most permissive buyers,” potentially leading to a “race to the bottom” in security standards within certain segments of the federal market.

The potential for this fragmented landscape was identified as the most significant risk introduced by the new policy. Chris Wysopal, Chief Security Evangelist at Veracode, pinpointed “inconsistency” as the primary danger, explaining that if different agencies begin creating their own bespoke attestation requirements, it could foster a counterproductive and chaotic environment for both vendors and the government. Software vendors would be forced to divert precious resources away from genuine security improvements—such as vulnerability research and patching—and toward the administrative burden of interpreting and responding to a confusing array of disparate contractual demands. This situation would not only create inefficiencies but could also introduce new security gaps, as complex and varied requirements might lead to compliance errors and oversights. Ultimately, the long-term impact of this policy shift would depend heavily on whether agencies could voluntarily maintain a disciplined and somewhat uniform approach to security in the absence of a direct federal mandate.
